LEGAL
Terms and Conditions
for purchasing Kasu Pro on kasuplayer.de
This is an English translation for your convenience. The German version is legally binding.
§ 1 Scope and provider
(1) These terms and conditions apply to all contracts for the purchase of Kasu Pro codes for the software “Kasu Player” concluded via the online shop at kasuplayer.de.
(2) The provider and contractual partner is: Recep Efe, Kasu Player, Willdenowstr. 12a, 13353 Berlin, Germany, email: support@kasuplayer.com.
(3) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB).
(4) Deviating terms of the customer do not become part of the contract unless we expressly agree to them.
§ 2 Description of services
(1) Kasu Player is software for playing IPTV playlists (M3U links and Xtream Codes logins). The basic version is free. A Kasu Pro code unlocks additional features described on the product page.
(2) Kasu Player does not include, provide or sell any TV channels, movies, series or other content, nor any access to IPTV services. Customers only use their own playlists and are responsible for making sure they are allowed to use them.
(3) A Kasu Pro code is provided for a one-time payment, without a subscription and without time limit. It can be activated on up to two devices at the same time. A device can be released again in the app under Settings → Kasu Pro.
(4) System requirements: currently Windows 10 or 11 (64-bit). An internet connection is required for activation; the app checks the code online regularly and stays unlocked for up to 30 days without a connection.
(5) We provide updates required to keep the product in conformity with the contract (§ 327f BGB). Other changes to the software are only made if they do not significantly impair the agreed Pro features.
§ 3 Conclusion of contract
(1) The presentation of the product in the shop is not a legally binding offer but an invitation to place an order.
(2) The customer adds Kasu Pro to the cart and enters their details during checkout. Before submitting, they can review and correct all entries. By clicking the “Place order and pay” button or the payment button of the selected payment service, the customer submits a binding offer to conclude the contract.
(3) We accept the offer by providing the code after receipt of payment (order confirmation page or email). With the confirmation email, the customer receives the content of the contract, these terms and the cancellation policy.
(4) The contract languages are German, English and Turkish. We store the contract text. Customers with an account can view their orders under “My account”.
§ 4 Prices and payment
(1) The prices in euros stated at the time of the order apply. As a small business within the meaning of § 19 German VAT Act (UStG), we do not charge or show VAT. There are no shipping costs.
(2) Payment is made via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg) or the payment methods offered there. PayPal’s terms of use apply in addition.
§ 5 Delivery
(1) The code is shown on the order confirmation page immediately after receipt of payment, sent by email and – if the customer has an account – available under “My account”. Pro is unlocked by entering the code in Kasu Player.
(2) We communicate with our customers exclusively by email. You receive the order confirmation, code, invoice and all other notices by email; nothing is sent by post. We answer requests by email at support@kasuplayer.com. Your statutory rights, in particular the right of withdrawal, remain unaffected.
§ 6 Rights of use
(1) Upon full payment, the customer receives the simple, non-transferable and unlimited right to use the Pro features of Kasu Player on up to two devices at the same time for their own purposes.
(2) The code may not be published, passed on or resold. In case of proven misuse, we may block the code.
(3) It is prohibited to modify or decompile the software or to circumvent protection mechanisms, unless permitted by law (§§ 69d, 69e German Copyright Act).
§ 7 Right of withdrawal
Consumers have a right of withdrawal in accordance with the cancellation policy. For digital content, the right of withdrawal expires early under the conditions described there. Consumers can also declare their withdrawal using our withdrawal function.
§ 8 Warranty
The statutory provisions on defects of digital products apply (§§ 327 et seq. BGB).
§ 9 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely), our liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.
(3) We are not responsible for the availability, quality or legality of the playlists and third-party content used by the customer.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
(3) Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
